We kindly inform you that media-press.tv Spółka Akcyjna with its registered office in Kraków (postal code: 30-047) at ul. Karola Szymanowskiego 1/15, entered in the register of entrepreneurs of the National Court Register maintained by the District Court for Kraków-Śródmieście in Kraków, 11th Commercial Division of the National Court Register, under KRS number: 0000011065, share capital PLN 5,200,000.00, fully paid up, NIP number: 527-234-17-98, REGON number: 017291553 (hereinafter referred to as “MEDIA-PRESS.TV” or the “Controller”), has, since 25 May 2018, processed personal data in accordance with the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (OJ EU L 2016.119.1) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, hereinafter referred to as the “GDPR Regulation” or “GDPR”.

1. MEDIA-PRESS.TV processes personal data lawfully and only in cases where at least one of the conditions specified in Article 6(1) of the GDPR Regulation is met, in particular:
1.1. the data subject has given consent;
1.2. processing is necessary for the performance of a contract;
1.3. processing is necessary for compliance with a legal obligation to which the controller is subject;
1.4. processing is necessary to protect the vital interests of the data subject or of another natural person;
1.5. processing is necessary for the purposes of legitimate interests pursued by the controller or by a third party.

2. In the process of personal data processing, MEDIA-PRESS.TV applies the following principles:
2.1. fairness and transparency – personal data is processed in a transparent manner for the data subject, and the data subject has the possibility to access their processed data and receives information about the purposes and principles of processing at the time the personal data is obtained, as well as information about their rights in connection with the processing of personal data;
2.2. purpose limitation – data is collected and processed only for specific, explicit and legitimate purposes;
2.3. data minimisation – the processed data is adequate for the purpose it serves, therefore data that may be considered excessive or unnecessary is not processed;
2.4. accuracy – Media-Press.TV makes every effort to ensure that the processed data is accurate and that persons whose data is processed have unrestricted right of access to such data and to supplement or rectify it;
2.5. storage limitation – personal data is stored only for the period necessary to achieve the purposes, and after that period it is permanently deleted;
2.6. integrity and confidentiality – MEDIA-PRESS.TV applies technical and organisational security measures that protect data against accidental or unlawful disclosure, and also allow protection against accidental or unlawful destruction or modification;
2.7. accountability – MEDIA-PRESS.TV documents the personal data processing process.

3. Persons whose data is processed have the following rights, unless they are limited by other legal provisions or make it impossible to achieve the purpose to which they relate:
a) the right to information exercised at the time data is obtained and during processing;
b) the right to rectify data;
c) the right to be forgotten;
d) the right to restrict processing;
e) the right to data portability;
f) the right to object.

4. In the process of personal data processing, MEDIA-PRESS.TV uses the services of other entities that process personal data on its behalf. The processing of personal data is entrusted only to entities that guarantee its security in accordance with the requirements of law and the security standards applicable at MEDIA-PRESS.TV.

5. In order to ensure the security of personal data, MEDIA-PRESS.TV applies technical and organisational safeguards that protect data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure of or unauthorised access to personal data transmitted, stored or otherwise processed, which may in particular lead to physical, material or non-material damage, in particular by:
a) appointing a Data Protection Officer in cases provided for in the GDPR Regulation and where such an obligation applies to the controller;
b) processing personal data only by authorised persons who have knowledge of security principles and obligations arising from the GDPR Regulation;
c) using computer equipment, software and ICT infrastructure equipped with safeguards ensuring the ongoing confidentiality, integrity, availability and resilience of processing systems and services, as well as the ability to quickly restore the availability of and access to personal data in the event of a physical or technical incident.

6. Each time before starting the processing of personal data, and periodically thereafter, processing operations are reviewed and the impact on data protection and the risk of a possible infringement of the rights and freedoms of persons in connection with processing are assessed.

7. Depending on the results of the above-mentioned analysis, MEDIA-PRESS.TV takes appropriate remedial measures to minimise risk and improve the security system.

8. No personal data processed by MEDIA-PRESS.TV will be subject to processing techniques consisting of profiling a natural person.

9. CUSTOMER DATA

9.1. Personal data of customers, i.e. recipients of MEDIA-PRESS.TV services and products, is processed for the purpose of performing the sales contract, consisting in providing customers with MEDIA-PRESS.TV products and services. The legal basis for processing is the contract concluded between MEDIA-PRESS.TV and the customer’s company pursuant to Article 6(1)(b) of the General Data Protection Regulation (GDPR).

9.2. The recipients of this personal data are entities authorised under applicable law and entities providing services on behalf of MEDIA-PRESS.TV, based on concluded data processing agreements.

9.3. Customers’ personal data is processed for the period necessary to fulfil obligations imposed on MEDIA-PRESS.TV by law and for the period necessary to establish, pursue or defend claims arising from concluded agreements.

9.4. Persons have the right to access and rectify their personal data, as well as the right to request deletion or restriction of processing, or the right to object to processing, and the right to data portability, provided that exercising these rights will not conflict with obligations imposed on the controller by generally applicable law or make it impossible to fulfil the purpose for which the data is processed.

9.5. Persons also have the right to lodge a complaint with the supervisory authority if they find that their personal data is processed unlawfully.

9.6. Providing personal data is voluntary, but necessary to perform the subject of the sales contract.

9.7. MEDIA-PRESS.TV does not use customer data for automated decision-making, including so-called profiling.

10. NEWSLETTER RECIPIENT DATA

10.1 Personal data of recipients of the newsletter is processed for the purpose of providing recipients with information about MEDIA-PRESS.TV products and services, including news, special offers, events organised by MEDIA-PRESS.TV or events in which we participate.

10.2. The legal basis for the processing of personal data is the consent of the newsletter recipient expressed pursuant to Article 6(1)(a) of the General Data Protection Regulation (GDPR).

10.3. The recipients of personal data are entities authorised under applicable law and entities providing services on behalf of MEDIA-PRESS.TV, based on concluded data processing agreements.

10.4. Personal data of newsletter recipients is processed for the period enabling the delivery of information or until consent is withdrawn by the recipient, which may occur by clicking the “Unsubscribe from newsletter” link or by sending us information by email to [email protected].

10.5. All persons whose personal data is processed by MEDIA-PRESS.TV have the right to access and rectify their personal data, as well as the right to request deletion or restriction of processing, or the right to object to processing, and the right to data portability, provided that exercising these rights will not conflict with obligations imposed on the controller by generally applicable law or make it impossible to fulfil the purpose for which the personal data is processed. These persons also have the right to lodge a complaint with the supervisory authority if they find that their data is processed unlawfully.

10.6. Providing personal data is voluntary, but necessary for the proper delivery of information electronically.

10.7. Personal data of newsletter recipients is not used for automated decision-making, including so-called profiling.

11. DATA OF DEMO OR TRIAL USERS

11.1. MEDIA-PRESS.TV offers customers the opportunity to become acquainted with its products, which are computer programs and IT systems, by providing them with temporary access to its products in time-limited or functionally limited versions, so-called demonstration or DEMO versions, and test versions, hereinafter referred to as “TRIAL Versions”.

11.2. In order to provide customers with TRIAL Versions, MEDIA-PRESS.TV registers the user and sends confirmation electronically, and then processes their personal data for the proper performance of the service.

11.3 The legal basis for the processing of personal data is the user’s consent expressed pursuant to Article 6(1)(a) of the General Data Protection Regulation (GDPR).

11.4 The recipients of this personal data are entities authorised under applicable law and entities providing services on behalf of MEDIA-PRESS.TV, based on concluded data processing agreements.

11.5. Users’ personal data is processed for the period enabling them to become acquainted with the TRIAL Version or until consent is withdrawn by the user, which may occur by clicking a special link or by sending us information by email to [email protected].

11.6. All persons whose personal data is processed by MEDIA-PRESS.TV have the right to access and rectify their personal data, as well as the right to request deletion or restriction of processing, or the right to object to processing, and the right to data portability, provided that exercising these rights will not conflict with obligations imposed on the controller by generally applicable law or make it impossible to fulfil the purpose for which the data is processed. These persons also have the right to lodge a complaint with the supervisory authority if they find that their data is processed unlawfully.

11.7. Providing personal data is voluntary, but necessary for the proper delivery of the service.

11.8. Users’ personal data is not used for automated decision-making, including so-called profiling.
